TheGeneralAdministrationofQualitySupervision,InspectionandQuarantinestipulatesthattherearemainlythefollowingsituationsofcounterfeitandinferiorproducts:
(1)CounterfeitorcounterfeitUsecertificationmarks,brand-nameproductmarks,inspection-freemarksandotherqualitymarksandlicensemarks;
(2)Forgedorusedfalseorigin;
(3)ForgedorImpersonatingthenameandaddressofanotherperson’sfactory;
(4)Impersonatinganotherperson’sregisteredtrademark;
(5)Doping,adulterating,passingfakeasreal,orshoddy
(6)Ineffectiveanddeteriorated;
(7)Thereisanunreasonabledangerthatendangershumanhealth,personalandpropertysafety
(8)Theindicatedindicatorsareinconsistentwiththeactualsituation;
(9)Therelevantnationallawsandregulationsexpresslyprohibitproductionandsales.
TheGeneralAdministrationofQualitySupervision,InspectionandQuarantinealsostipulatesthatifthefollowingproductsaresoldwithoutcorrections,theyaredeemedtobesoldasfakeandinferiorproducts:
(1)NoinspectioncertificateorpermissionfromtherelevantunitSalescertificates;
(2)Domesticproductsarenotmarkedwiththename,producerandplaceoforigininChinese(importantindustrialproductsarenotmarkedwiththefactoryaddress);
(3)ForlimitedtimeuseFailuretoindicatetheexpirationtime;
(4)Implementationofproduction(manufacturing)licensemanagementwithoutindicatingthelicensenumberandexpirationdate;
(5)UseChinesetoindicateinaccordancewithrelevantregulationsSpecifications,grades,maintechnicalindicatorsoringredients,content,etc.butnotmarked;
(6)High-endconsumerdurableswithoutChineseinstructions;
(7)Treatedproducts(Includingdefectiveproductsandothernon-products)withoutmarkingtheword"processedproduct"inaprominentpartoftheproductorpackaging;
(8)Highlytoxic,flammable,explosiveandotherdangerousgoodswithoutindicatingrelevantLogoandinstructionsforuse.
