Inordertoregulatecompulsoryproductcertification,improvetheeffectivenessofcertification,andsafeguardnational,socialandpublicinterests,accordingtothe"People’sRepublicofChinaTheRegulationsonCertificationandAccreditation(hereinafterreferredtoastheRegulationsonCertificationandAccreditation)andotherlaws,administrativeregulationsandrelevantnationalregulations,formulatetheseregulations.
Article2
Inordertoprotectnationalsecurity,preventfraud,protecthumanhealthorsafety,protectanimalandplantlifeorhealth,andprotecttheenvironment,relevantproductsspecifiedbythestatemustbecertified(Hereinafterreferredtoascompulsoryproductcertification)andmarkedwiththecertificationmarkbeforeleavingthefactory,selling,importingorusingitinotherbusinessactivities.
Article3
TheGeneralAdministrationofQualitySupervision,InspectionandQuarantine(hereinafterreferredtoastheGeneralAdministrationofQualitySupervision,InspectionandQuarantine)isinchargeofthenationalcompulsoryproductcertification.
TheNationalCertificationandAccreditationAdministration(hereinafterreferredtoastheNationalCertificationandAccreditationAdministration)isresponsiblefortheorganization,implementation,supervisionandmanagementandcomprehensivecoordinationofthenationalcompulsoryproductcertification.
Localqualityandtechnicalsupervisiondepartmentsatalllevelsandlocalentry-exitinspectionandquarantineagencies(hereinafterreferredtoaslocalqualityinspectionandquarantinebureaus)areresponsibleforthesupervision,managementandlawenforcementofcompulsoryproductcertificationactivitiesintheirjurisdictionsinaccordancewiththeirrespectivedutiesInvestigatework.
Article4
Forproductssubjecttocompulsoryproductcertification,thestateshallunifytheproductcatalog(hereinafterreferredtoasthecatalog),unifythemandatoryrequirements,standardsandconformityassessmentproceduresoftechnicalspecifications,Unifiedcertificationmarkandunifiedchargingstandard.
TheGeneralAdministrationofQualitySupervision,InspectionandQuarantineandtheNationalCertificationandAccreditationAdministrationofthePeople'sRepublicofChinaandtherelevantdepartmentsoftheStateCouncilformulateandadjustthecatalog.
Article5
Thestateencouragestheimplementationofequalandmutuallybeneficialinternationalmutualrecognitionactivitiesforcompulsoryproductcertification.ThemutualrecognitionactivitiesshallWithintheframeworkofinternationalmutualrecognitionagreementssignedbyrelevantdepartments.
Article6
Organizationsandtheirpersonnelengagedincompulsoryproductcertificationactivitiesshallberesponsibleforthetradesecrets,productiontechnology,craftsmanshipandothertechnicalsecretsandinformationtheyknowaboutintheirbusinessactivities.Haveconfidentialityobligations.
Implementationofcertification
Article7
ThebasicspecificationsforcompulsoryproductcertificationareformulatedandissuedbytheGeneralAdministrationofQualitySupervision,InspectionandQuarantineandtheStateCertificationandAccreditationAdministration.CompulsoryproductcertificationTherules(hereinafterreferredtoasthecertificationrules)areformulatedandpromulgatedbytheCNCA.
Article8
Compulsoryproductcertificationshallbeapplicabletothefollowingsinglecertificationmodeoracombinationofmultiplecertificationmodes.Thespecificmodesinclude:
(1)DesignAppraisal;
(2)Typetest;
(3)Sampletestingorinspectionattheproductionsite;
(4)Marketsamplingtestorinspection;
(5)Enterprisequalityassuranceabilityandproductconsistencyinspection;
(6)Follow-upinspectionaftercertification.
Theproductcertificationmodelshouldbebasedontheperformanceoftheproduct,andthecomprehensivefactorsrelatedtopublicsafety,humanhealthandenvironment,thelifecycleoftheproduct,theriskstatusofproduction,andtheriskofimportedproducts,etc.Theprinciplesofscienceandconveniencearedetermined.
Article9
Thecertificationrulesshallincludethefollowing:
(1)Applicableproductrange;
(2)ApplicableCompulsoryrequirementsofnationalstandards,industrystandardsandnationaltechnicalspecificationscorrespondingtotheproducts;
(3)Certificationmode;
(4)Principlesorregulationsforthedivisionofapplicationunits;
(5)Samplingandsampledeliveryrequirements;
(6)Confirmationrequirementsforkeycomponentsorrawmaterials(whennecessary);
(7)Testingstandards(Whennecessary);
(8)Requirementsforfactoryinspection;
(9)Requirementsforfollow-upinspectionaftercertification;
(10)Requirementsforthevalidityperiodofthecertification;
(11)Requirementsforthecertificationmarkofthecertifiedproducts;
(12)Otherregulations.
Article10
Theproducersorsellersandimportersofproductslistedinthecatalogue(hereinaftercollectivelyreferredtoasthecertificationprincipal)shallentrustthecertificationbodydesignatedbytheCNCA(hereinafter(Referredtoasthecertificationbody)tocertifytheproductsitproduces,sellsorimports.
Ifotherenterprisesareentrustedtoproduceproductslistedinthecatalog,theentrustingenterpriseortheentrustedenterprisemayentrustcertificationtothecertificationbody.
Article11
Thecertificationprincipalshallproviderelevanttechnicalmaterialstothecertificationbodyinaccordancewiththespecificproductcertificationrules.
Whenthesellerorimporteristhecertificationprincipal,theyshouldalsoprovidethecertificationbodywithacopyoftherelevantcontractconcludedbetweenthesellerandthemanufacturerortheimporterandthemanufacturer.
Ifotherenterprisesareentrustedtoproducetheproductslistedinthecatalog,thecertificationclientshallalsoprovidethecertificationbodywithacopyoftherelevantcontractbetweentheentrustingenterpriseandtheentrustedenterprise.
Article12
Afterthecertificationbodyacceptsthecertificationentrustment,itshallarrangeproducttypetestingandfactoryinspectioninaccordancewiththespecificproductcertificationrules.
Article13
Thecertificationclientshallensurethatthesamplesitprovidesareconsistentwiththeactualproductsproduced,andthecertificationbodyshallreviewtheauthenticityofthesamplesprovidedbythecertificationclient.
Thecertificationbodyshall,inaccordancewiththerequirementsofthecertificationrules,andaccordingtotheproductcharacteristicsandactualconditions,adoptsamplingmethodssuchassampledeliverybythecertificationclient,on-sitesampling,orsampledeliverybythecertificationclientafteron-sitesealing.ThelaboratoriesdesignatedbyCNCA(hereinafterreferredtoaslaboratories)conductproducttypetestsonsamples.
Article14
Thelaboratoryshallensurethatthetestconclusionsaretrueandaccuratewhenconductingproducttypetestsonsamples,andshallmakeacompleterecordoftheentiretestprocess,fileitforretention,andensurethetestTherecordsoftheprocessandresultsaretraceableandcooperatewiththecertificationbodytocarryouteffectivefollow-upinspectionofthecertifiedproducts.
Laboratoryandrelatedpersonnelshallberesponsibleforthecontentofthetestreportandtestconclusionsitmakes.Ifthereisanydoubtabouttheauthenticityofthesample,theyshallexplainthesituationtothecertificationbodyanddealwithitaccordingly.
Article15
Wherefactoryinspectionsarerequired,thecertificationbodyshallappointcompulsoryproductcertificationinspectorswithnationalregistrationqualificationstoensurethequalityassurancecapabilitiesandproductionTheconsistencyoftheproductandthetypetestsampleshallbecheckedinaccordancewiththespecificproductcertificationrules.
Thecertificationbodyanditscompulsoryproductcertificationinspectorsshallberesponsiblefortheinspectionconclusions.
Article16
Afterthecertificationbodyhascompletedtheproducttypetestandfactoryinspection,ifitmeetsthecertificationrequirements,itwillgenerallyissueacertificatetothecertificationclientwithin90daysofacceptingthecertificationentrustmentCertificationcertificate.
Ifthecertificationrequirementsarenotmet,thecertificationclientshallbenotifiedinwritingandthereasonsshallbeexplained.
Thecertificationbodyanditsrelatedpersonnelshallberesponsibleforthecertificationconclusionstheymake.
Article17
Certificationagenciesshallconducton-siteproducttestingorinspection,marketproductsamplingtestingorinspection,qualityassuranceabilityinspection,etc.Implementclassifiedmanagementandeffectivefollow-upinspections,controlandverifytheconsistencybetweenthecertifiedproductsandthetypetestsamples,andthequalityassurancecapabilitiesofthemanufacturercontinuetomeetthecertificationrequirements.
Article18
Thecertificationbodyshallmakeacompleterecordofthewholeprocessoffollow-upinspection,fileitandkeepit,andensurethetraceabilityofthecertificationprocessandresults.
Forthosewhocannotcontinuetomeetthecertificationrequirements,thecertificationbodyshallsuspendorrevokethecertificationcertificateaccordingtothecorrespondingsituation,andannounceit.
Article19
Certificationagenciesshallfollowthecertificationrules,basedonthesafetylevelofthecertifiedproduct,productqualitystability,andthegoodandbadrecordsoftheproductmanufacturerAndotherfactors,conductclassifiedmanagementoffollow-upinspectionsoncertifiedproductsandtheirmanufacturingenterprises,anddetermineareasonablefrequencyoffollow-upinspections.

Article20
TheCNCAuniformlystipulatestheformat,contentandcompulsoryrequirementsofcompulsoryproductcertificationcertificates(hereinafterreferredtoascertificationcertificates)Thestyleandtypeofthesexproductcertificationmark(hereinafterreferredtoasthecertificationmark).
Article21
Thecertificationcertificateshallincludethefollowingbasiccontents:
(1)Thenameandaddressofthecertificationprincipal;
(2)Thenameandaddressoftheproductproducer(manufacturer);
(3)Thenameandaddressoftheentrustedproductioncompany(whennecessary);
(4)ThenameandaddressoftheproductProductseries,specifications,models;
(5)Certificationbasis;
(6)Certificationmode(whenneeded);
(7)DateofissuanceAndvalidityperiod;
(eight)issuingauthority;
(nine)certificatenumber;
(ten)othercontentthatneedstobemarked.
Article22
Thevalidityperiodofthecertificationis5years.
Thecertificationbodyshall,basedonitsfollow-upinspectionofthecertifiedproductanditsmanufacturingenterprise,indicateonthecertificationcertificatethequerywebsiteandtelephonenumberfortheeffectivestatusoftheannual(2010)inspection.
Ifthevalidityperiodofthecertificationcertificateexpiresanditneedstobeusedforrenewal,thecertificationclientshallapplyfortheapplicationwithin90daysbeforethevalidityperiodofthecertificationcertificateexpires.
Article23
Ifthecontentofthecertificationcertificateismarkedonthecertifiedproductanditssalespackage,itshallbeconsistentwiththecontentofthecertificationcertificateandcomplywiththerelevantnationalproductidentificationLabelmanagementregulations.
Article24
Inanyofthefollowingcircumstances,thecertificationclientshallapplytothecertificationbodyforthechangeofthecertificationcertificate,andthecertificationbodyshallmakecorrespondinghandlingaccordingtodifferentsituations:
(1)Ifthenamingmethodofthecertifiedproductischangedandtheproductname,modelischanged,orthenameoftheproducer,manufacturer,oraddressofthecertifiedproductischanged,thecertificationcertificateshallbechangedafterverificationbythecertificationbody;
(2)Themodelofthecertifiedproductischanged,butdoesnotinvolvechangesintheinternalstructureofsafetyperformanceandelectromagneticcompatibility;orifthecertifiedproducthasreducedthesameproductmodel,thecertificationcertificateshallbechangedafterconfirmationbythecertificationbody;
p>(3)Ifthekeycomponents,specificationsandmodelsofthecertifiedproduct,aswellasthedesign,structure,processandmaterialorrawmaterialmanufacturerrelatedtothesafetyorelectromagneticcompatibilityofthewholemachinearechanged,thecertificationbodyshallre-testAfterpassingthecertificate,changethecertificate;
(4)Ifthelocationofthecertifiedproductmanufactureroritsqualityassurancesystem,productionconditions,etc.change,thecertificateshallbechangedafterthecertificationbodyre-inspectsthefactory;

(5)Othercircumstancesthatshouldbechanged.
Article25
Ifthecertificationclientneedstoextendthecoverageofitscertifiedproduct,itshallapplytothecertificationbodyfortheextensionofthecertificationcertificate,andthecertificationbodyshallverifytheextensionoftheproductandtheoriginalTheconsistencyofthecertifiedproductconfirmsthevalidityoftheoriginalcertificationresultfortheextendedproduct.Afterthequalificationisconfirmed,thecertificationcertificatemaybeissuedseparatelyorre-issuedaccordingtotherequirementsofthecertificationclient.
Certificationbodiescansupplementproducttypetestsorfactoryinspectionsfordifferencesinaccordancewiththerequirementsofthecertificationrules.
Article26
Inanyofthefollowingcircumstances,thecertificationbodyshallcancelthecertificationcertificateandpublishittothepublic:
(1)ThevalidityperiodofthecertificationcertificateUponexpiration,thecertificationclienthasnotappliedforrenewal;
(2)Thecertifiedproductisnolongerinproduction;
(3)Thecertifiedproductmodelhasbeenincludedinthestate’sexpliciteliminationorbanThecatalogofproductsproduced;
(4)Thecertificationclientappliesforcancellation;
(5)Othercircumstancesthatshouldbecancelledaccordingtolaw.
Article
Article27
Inanyofthefollowingcircumstances,thecertificationbodyshallsuspendthecertificationcertificatewithinthetimelimitspecifiedinthecertificationrulesandannounceittothepublic:
(1)Thecertificationbasisorcertificationrulesapplicabletotheproductarechanged,andtheproductdoesnotmeetthechangerequirementswithinthespecifiedtimelimit;
(2)Thecertificationclientisfoundtoviolatethecertificationduringthefollow-upinspectionRules,etc.;
(3)Refusingtoacceptfollow-upinspectionwithoutjustifiablereasonsorfindingthattheproductcannotcontinuetomeetthecertificationrequirementsafterfollow-upinspection;
(4)Thecertificationclientappliesforsuspension;
(5)Othercircumstancesthatshouldbesuspendedaccordingtolaw.
Article28
Inanyofthefollowingsituations,thecertificationbodyshallrevokethecertificationcertificateandannounceittothepublic:
(1)CertifiedproductsTherearedefectsthatcausequalityandsafetyaccidents;
(2)Inthefollow-upinspection,itisfoundthatthecertifiedproductisinconsistentwiththesampleprovidedbythecertificationclient;
(3)Duringthesuspensionofthecertificationcertificate,Thecertificationclientfailstotakecorrectivemeasuresorisstillunqualifiedafterrectification;
(4)Thecertificationclientobtainsthecertificationcertificatebyfraud,briberyandotherimpropermeans;
(5)Othercircumstancesthatshouldberevokedaccordingtolaw.
Article29
Wherethecertifiedproductiscancelled,suspendedorwithdrawn,thecertificationbodyshalldeterminethecategoryandscopeoftheproductthatdoesnotmeetthecertificationrequirements.
Fromthedateofcancellationorrevocationofthecertificationcertificateorduringthesuspensionperiodofthecertificationcertificate,productsthatdonotmeetthecertificationrequirementsshallnotcontinuetobeshipped,sold,importedorusedinotherbusinessactivities.
Article30
Thestyleofthecertificationmarkiscomposedofbasicpatternsandcertificationtypes.
"CCC"inthebasicpatternistheabbreviationoftheEnglishnameof"ChinaCompulsoryCertification".
Article31
Thecertificationtypeismarkedontherightsideofthebasicpatternofthecertificationmark,whichiscomposedofabbreviationsofEnglishwordsrepresentingthecertificationtypeoftheproduct.
Accordingtotheneedsofcompulsoryproductcertification,theCNCAhasformulatedspecificrequirementsforthelabelingofcertificationtypes.
Article32
Thecertificationclientshallestablishacertificationmarkusemanagementsystem,truthfullyrecordandarchivetheuseofthecertificationmark,anddisplaytheproductanditspackaginginaccordancewiththecertificationrules.,Advertisements,productintroductionsandotherpublicitymaterials,correctlyuseandmarkthecertificationmark.
Article33
Anyunitorindividualshallnotforge,alter,fraudulentlyuse,tradeortransfercertificationcertificatesandcertificationmarks.
Supervisionandmanagement
Article34
Theimplementationyearofthecertification,inspectionandtestingactivitiesofcertificationbodies,inspectionbodiesandlaboratoriesbytheCNCASupervisionandinspectionandirregularspecialsupervisionandinspection.
Article35
Thecertificationbodyshallprovidethecertificationprincipalofthecertifiedproduct,thecertifiedproductanditsmanufacturer,andtheinformationonthecancellation,suspensionorrevocationofthecertificationcertificateReporttotheNationalCertificationandAccreditationAdministrationandtheprovinciallocalqualityinspectionbureaus.
Article36
AsaunifiedplanoftheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,theStateCertificationandAccreditationAdministrationadoptsregularorirregularmethodstosuperviseandinspectcertifiedproducts.
Producers,sellers,importersandusersofcertifiedproductsshallnotrefusetosuperviseandinspect.
TheNationalCertificationandAccreditationAdministrationestablishesasystemforpublishingcertifiedproductsandtheirproducers,andannouncestheresultsofsupervisionandinspectiontothepublic.
Article37
Thetwolocalqualityinspectionbureausshallsuperviseandinspectcompulsoryproductcertificationactivitiesintheirjurisdictionsinaccordancewiththeirrespectiveresponsibilitiesinaccordancewiththelaw,andinvestigateanddealwithillegalacts.
Iftheproductslistedinthecataloghavenotbeencertified,buthavenotyetleftthefactoryorsold,thelocalqualityinspectionandinspectionbureausshouldwarntheirproductmanufacturerstocarryoutcompulsoryproductcertificationinatimelymanner.
Article38
Whenthetwolocalqualityinspectionbureauscarryoutcompulsoryproductcertificationsupervisionandinspection,theymayentertheproductionandbusinesspremisesaccordingtolawtocarryouton-siteinspections,andconsultandcopyrelevantcontractsandbills.,Accountbooksandotherinformation,sealup,seizeuncertifiedproductsorproductsthatdonotmeetcertificationrequirements.
Article39
Producersandsellersofproductslistedinthecatalogfindthattheproductstheyproduceandsellhavehiddensafetyhazards,whichmaycauseharmtohumanhealthandlifesafety,Shouldpublishrelevantinformationtothepublic,taketheinitiativetotakereliefmeasuressuchasrecallingproducts,andreporttorelevantsupervisionandmanagementdepartmentsinaccordancewithrelevantregulations.
Iftheproducersandsellersoftheproductslistedinthecatalogfailtofulfilltheobligationsstipulatedintheprecedingparagraph,theGeneralAdministrationofQualitySupervision,InspectionandQuarantineshallinitiatetheproductrecallprocedure,ordertheproducertorecalltheproduct,andthesellertostopsellingtheproduct.
Article40
Theentry-exitinspectionandquarantineagencyshallimplemententryverificationmanagementfortheimportedproductslistedinthecatalog,checkcertificationcertificates,certificationmarksandothersupportingdocuments,andcheckwhetherthegoodscertificatesareMatch.Iftheverificationfails,itshallbedealtwithinaccordancewithrelevantlawsandregulations,andfollow-upsupervisionofimportedproductslistedinthecatalogshallbeimplemented.
Article41
Iftheimportedarticleslistedinthecatalogmeetoneofthefollowingcircumstances,thereisnoneedtoapplyforcompulsoryproductcertificationuponentry:
(1)Articlesforpersonaluseofforeignembassies,consulatesorinternationalorganizationsinChinaandtheirdiplomaticpersonnel;
(2)ArticlesforpersonaluseofofficialagenciesofthegovernmentsofHongKongandMacaoSpecialAdministrativeRegionsintheMainlandandtheirstaff;
(3)Articlesforpersonalusebroughtbyimmigrantsfromabroad;
(4)Articlesaidedanddonatedbyforeigngovernments;
(5)Othersituationswherethereisnoneedtoapplyforcompulsoryproductcertificationinaccordancewiththelaw.
Article42
Inanyofthefollowingcircumstances,theproducer,importer,selleroragentoftheproductlistedinthecatalogmayconductentry-exitinspectionandquarantineatthelocalityTheagencysubmitsapplicationsforexemptionfromcompulsoryproductcertification,submitsrelevantcertificationmaterials,liabilityguarantees,productconformitystatements(includingtypetestreports)andothermaterials,andconductsproducttestingasneeded,andobtainsthe"ExemptionfromCompulsoryProductCertification"Onlyafterthecertification"canbeimportedandusedinaccordancewiththedeclaredpurpose:(1)Productsrequiredforscientificresearchandtesting;
Partsrequired;
(3)Productsdirectlyrequiredforend-usermaintenancepurposes;
(4)Equipment/componentsrequiredforthefactoryproductionline/completeproductionline(notIncludingofficesupplies);
(5)Productsthatareonlyusedforcommercialdisplaybutnotforsale;
(6)Productsthatneedtobereturnedafterbeingtemporarilyimported(includingexhibitions)Products);
(7)Partsimportedbygeneraltradeforthepurposeofexportingtheentiremachine;
(8)PartsimportedforthepurposeofexportingtheentiremachineImportedpartsorcomponentsprocessedbysuppliedmaterials;
(9)Othercircumstancesthatareexemptfromcompulsoryproductcertificationduetospecialpurposes.
Article43
Ifcertificationbodies,inspectionagencies,andlaboratorieshaveoneofthefollowingcircumstances,theCNCAshallorderthemtosuspendbusinessforrectification.Duringtherectificationperiod,theyshallnotengageindesignatedCompulsoryproductcertification,inspectionandtestingactivitieswithinthescope:
(1)Increase,decrease,omitorchangetheproceduresstipulatedinthebasiccertificationspecificationsandcertificationrules;
(2))Failuretoimplementeffectivefollow-upinvestigationsonthecertifiedproducts,ordiscoverthatthecertifiedproductscannotcontinuetomeetthecertificationrequirements,andfailtosuspendorrevokethecertificationcertificateintimeandpublishit;
(3)Failuretoconductcertification,Makecompleterecordsofinspectionsandtestingprocesses,archivethem,andthecircumstancesareserious;
(4)Usepersonnelwhohavenotobtainedthecorrespondingqualificationstoengageincertification,inspection,andtestingactivities,andthecircumstancesareserious;
(5)Failuretoeffectivelyreviewtheauthenticityofthesamplesprovidedbythecertificationclient;
(6)Obstructingorinterferingwiththeinspectionofthecertificationlawenforcementbytheregulatoryauthority;
(7))Compulsoryproductcertificationforproductsthatarenotinthecatalog;
(8)Otherviolationsoflawsandregulations.
Article44
Inanyofthefollowingcircumstances,theCNCAmayrevokethecertificationagency,inspectionagency,andlaboratoryDesignationoftheoffice:
(1)Staffmembersabusetheirpowersorneglecttheirdutiestomakedesignateddecisions;
(2)Gobeyondstatutorypowerstomakedesignateddecisions;
(3)Violatingstatutoryprocedurestomakeadesignateddecision;
(4)Approvingthedesignationofcertificationbodies,inspectionagencies,andlaboratoriesthatdonothavethedesignatedqualifications;
(5)Othercircumstancesunderwhichthedesignationdecisioncanberevokedinaccordancewiththelaw.
Article45
Ifthecertificationbody,inspectionagencyorlaboratoryobtainsthedesignationbyfraud,briberyorotherimpropermeans,theCNCAshallrevokethedesignationandannounceit.
Thecertificationbody,inspectionagencyorlaboratoryshallnotapplyfordesignationagainwithin3yearsfromthedateofcancellationofthedesignation.
Article46
Ifpersonnelengagedincompulsoryproductcertificationactivitiesissuefalseoruntrueconclusions,fabricatefalseoruntruedocumentsorrecords,theirpracticequalificationsshallberevoked;Within5yearsfromthedateofrevocation,thecertificationpersonnelregistrationagencyoftheChinaCertificationandAccreditationAssociationwillnolongeracceptitsregistrationapplication.
Article47
Ifthecertificationclienthasobjectionstothecertificationdecisionofthecertificationbody,hecanappealtothecertificationbody.Ifhestillhasobjectionstothecertificationbody’shandlingresults,hecanAppealtotheCNCA.
Article48
AnyunitorindividualhastherighttoreporttotheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,theStateCertificationandAccreditationAdministrationorlocalauthoritiesforviolationsoflawsandregulationsincompulsoryproductcertificationactivities.Whenreportingbythetwoinspectionbureaus,theGeneralAdministrationofQualitySupervision,InspectionandQuarantine,theNationalCertificationandAccreditationAdministrationorthelocalqualityinspectionbureausshallinvestigateanddealwithitinatimelymanner,andkeepthereporterconfidential.

Article49
Productslistedinthecatalogarenotcertified,andareshipped,sold,importedorusedinotherbusinessactivitieswithoutauthorizationIfitisfound,thetwolocalqualityinspectionbureausshallimposepenaltiesinaccordancewithArticle67oftheCertificationandAccreditationRegulations.
Article50
Aftertheproductslistedinthecatalogarecertified,theydonotengageinproductionandbusinessactivitiesinaccordancewithstatutoryconditionsandrequirements,orproduceandsellproductsthatdonotmeetstatutoryrequirements.ThetwolocalqualityinspectionbureausshalldealwithitinaccordancewiththeprovisionsofArticle2andArticle3,paragraph2ofthe"SpecialProvisionsoftheStateCouncilonStrengtheningtheSupervisionandAdministrationofFoodandOtherProducts".
Article51
InviolationofthesecondparagraphofArticle29oftheseregulations,duringthecancellation,revocationorsuspensionofthecertificationcertificate,productsthatdonotmeetthecertificationrequirementswillcontinuetoleavethefactory.,Sales,import,oruseinotherbusinessactivities,thelocalqualityinspectionbureausshallimposepenaltiesinaccordancewithArticle67oftheCertificationandAccreditationRegulations.
Article52
InviolationofArticle42oftheseregulations,fabricatedfalsematerialstodefraudthe"CertificateofExemptionfromCompulsoryProductCertification"orobtainthe"ExemptionfromCompulsoryProductCertification"Iftheproductisnotusedaccordingtotheoriginaldeclaredpurposeafterthe“ProofofSexualProductCertification”,theentry-exitinspectionandquarantineagencyshallorderittomakecorrections,revokethe“CertificateofExemptionfromCompulsoryProductCertification”,andimposepenaltiesinaccordancewithArticle67oftheCertificationandAccreditationRegulations.
Article53
Wherethecertificationcertificateisforged,altered,leased,lent,fraudulentlyused,traded,ortransferred,thelocalqualityinspectionandinspectionbureaushallorderittomakecorrectionsandimpose3Tenthousandyuanfine.
Ifthecertificationmarkistransferredorresold,thelocalqualityinspectionandinspectionbureaushallorderittomakecorrectionsandimposeafineoflessthan30,000yuan.
Article54
Inanyofthefollowingcircumstances,thelocalqualityinspectionandinspectionbureaushallorderittomakecorrectionsandimposeafineoflessthan30,000yuan:
(1)ViolatingthefirstparagraphofArticle13oftheseregulations,andthesamplesprovidedbythecertificationclientareinconsistentwiththeactualproducts;
(2)ViolatingtheprovisionsofArticle24oftheseregulations,Failingtoapplytothecertificationbodyforthechangeofcertificationcertificateinaccordancewiththeregulations,andwithoutauthorizationtoleavethefactory,sell,importorusetheproductslistedinthecataloginotherbusinessactivities;
(3)ViolatetheprovisionsofArticle25oftheseregulations,Failingtoapplytothecertificationbodyforextensionofthecertificationcertificateinaccordancewiththeregulations,andarbitrarilyleavingthefactory,selling,importing,orusingthelistedproductsinotherbusinessactivities.
Article55
Inanyofthefollowingcircumstances,thelocalqualityinspectionandinspectionbureausshallorderthemtomakecorrectionswithinatimelimit,andiftheyfailtomakecorrectionswithinthetimelimit,afineoflessthan20,000yuanshallbeimposed.
(1)InviolationofArticle23oftheseregulations,thecontentofthecertificationcertificatemarkedonthecertifiedproductanditssalespackageisinconsistentwiththecontentofthecertificationcertificate;
(2)ViolatingtheprovisionsofArticle32oftheseregulationsandfailingtousethecertificationmarkinaccordancewiththeregulations.
Article56
Ifthecertificationbody,inspectionagency,orlaboratoryissuesfalseconclusionsortheconclusionsissuedareseriouslyinaccurate,theCNCAshallrevokeitsdesignation;Theresponsiblepersoninchargeandthepersondirectlyresponsibleshallhavetheircorrespondingqualificationsrevoked;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw;ifalossiscaused,thecorrespondingcompensationliabilityshallbeassumed.
Article57
Ifthecertificationbody,inspectionagency,orlaboratoryhasoneofthefollowingcircumstances,theCNCAshallorderthemtomakecorrections,andifthecircumstancesareserious,theyshallberevoked.Designateuntiltheapprovalofthecertificationbodyisrevoked.
(1)Engaginginthecertificationofcatalogproductsandcertification-relatedtestingandinspectionactivitiesbeyondthedesignatedbusinessscope;
(2)Transferringthedesignatedcertificationbusiness;
(3)Continuetoengageincompulsoryproductcertification,inspection,andtestingactivitieswithinthedesignatedscopeduringtheperiodofbusinessclosureforrectification;
(4)Aftertheperiodofbusinessclosureforrectification,theinspectionstillfailstomeettherequirementsRectificationrequirements.
Article58
WheretheNationalCertificationandAccreditationAdministrationandthelocalqualityinspectionbureausandtheirstaffabusetheirpowers,practicefavoritism,orneglecttheirduties,theyshallbegivenadministrativesanctionsinaccordancewiththelaw;Anyonewhocommitsacrimeshallbeinvestigatedforcriminalresponsibilityinaccordancewiththelaw.
Article59
Forotherillegalactivitiesincompulsoryproductcertificationactivities,penaltiesshallbeimposedinaccordancewithrelevantlawsandadministrativeregulations.

Article60
Compulsoryproductcertificationshallbechargedinaccordancewithrelevantnationalregulations.
Article61
TheAQSIQisresponsiblefortheinterpretationofthisregulation.
Article62
TheseregulationsshallcomeintoforceonSeptember1,2009.The"ManagementRegulationsonCompulsoryProductCertification"promulgatedbytheGeneralAdministrationofQualitySupervision,InspectionandQuarantineonDecember3,2001shallberepealedatthesametime.
