ChapterOneGeneralProvisions
Article1istoregulateonlinecommoditytransactionsandrelatedservicebehaviors,protectthelegitimaterightsandinterestsofconsumersandoperators,andpromotethesustainableandhealthydevelopmentoftheonlineeconomy.ContractLaw,TortLiabilityLaw,ConsumerRightsProtectionLaw,ProductQualityLaw,Anti-UnfairCompetitionLaw,TrademarkLaw,AdvertisingLaw,FoodSafetyLawandElectronicTheSignatureLawandotherlawsandregulationsformulatethesemeasures.
Article2InternetcommodityoperatorsandInternetserviceoperatorsengaginginonlinecommoditytransactionsandrelatedserviceswithintheterritoryofthePeople’sRepublicofChinashallabidebythelaws,regulationsandthisTheprovisionsofthemethod.
Article3Theterm“Internetcommodityoperators”mentionedintheseMeasuresreferstolegalpersons,othereconomicorganizationsornaturalpersonsthatsellcommoditiesthroughtheInternet.
ThenetworkserviceoperatorsmentionedintheseMeasuresrefertolegalpersons,othereconomicorganizationsornaturalpersonsthatproviderelevantbusinessservicesthroughtheInternet,andwebsiteoperatorsthatprovideonlinetradingplatformservices.
Article4Theadministrativedepartmentforindustryandcommerceencouragesandsupportsthedevelopmentofonlinecommoditytransactionsandrelatedserviceactivities,implementsmoreactivepolicies,andpromotesthedevelopmentoftheonlineeconomy.Improvetheoverallqualityandmarketcompetitivenessofnetworkcommodityoperatorsandnetworkserviceoperators,andgiveplaytotheroleofthenetworkeconomyinpromotingnationaleconomicandsocialdevelopment.
Article5Theadministrativedepartmentforindustryandcommerceprovidesafair,just,standardized,andorderlymarketenvironmentforonlinecommoditytransactionsandrelatedserviceactivitiesinaccordancewiththeirfunctions,andpromotesandcreatesanhonestmarketAtmosphere,protectthelegitimaterightsandinterestsofconsumersandoperators.
Article6InternetcommodityoperatorsandInternetserviceoperatorsshallnotharmthenationalandpublicinterestsinonlinecommoditytransactionsandrelatedservices,andshallnotharmthelegitimaterightsandinterestsofconsumers.
Article7InternetcommodityoperatorsandInternetserviceoperatorsshallfollowtheprincipleofhonestyandcredibilityinonlinecommoditytransactionsandrelatedserviceactivities,andabidebyrecognizedbusinessethics.
Article8InternetcommodityoperatorsandInternetserviceoperatorsshallfollowtheprinciplesoffairness,justiceandvoluntarinessinonlinecommoditytransactionsandrelatedserviceactivities,safeguardnationalinterests,andundertakeSocialresponsibility.
Article9Encourageandsupportnetworkcommodityoperatorsandnetworkserviceoperatorstoestablishindustryassociations,establishanetworkintegritysystem,strengthenindustryself-discipline,andpromoteindustrycreditconstruction.
ChapterIIObligationsofInternetCommodityOperatorsandInternetServiceOperators
Article10Legalpersons,othereconomicorganizations,orindividualindustrialandcommercialhouseholdsthathaveregisteredandreceivedbusinesslicenseswhoengageincommoditytransactionsandrelatedserviceactivitiesthroughtheInternetshallpublishtheinformationpostedintheirbusinesslicenseortheirTheelectroniclinkidentificationofthebusinesslicense.
NaturalpersonswhoengageincommoditytransactionsandrelatedservicesthroughtheInternetshallapplytotheoperatorsthatprovideonlinetradingplatformservicesandsubmittheirrealidentityinformationsuchastheirnamesandaddresses.Thosewhomeettherequirementsforregistrationshallgothroughindustrialandcommercialregistrationinaccordancewiththelaw.
Article11Thegoodsorservicestradedonlineshallcomplywiththeprovisionsoflaws,regulations,andrules.Forgoodsorservicesthatareprohibitedbylawsandregulations,businessoperatorsshallnotconducttransactionsontheInternet.
Article12InternetcommodityoperatorsandInternetserviceoperatorsprovidinggoodsorservicestoconsumersshallabidebythe"ConsumerRightsProtectionLaw"and"ProductQualityLaw"Theprovisionsoflaws,regulations,andrulesshallnotharmthelegitimaterightsandinterestsofconsumers.
Article13InternetcommodityoperatorsandInternetserviceoperatorsprovidingcommoditiesorservicestoconsumersshallexplaintoconsumersthename,typeandquantityofcommoditiesorservicesinadvance,Quality,price,freight,deliverymethod,paymentmethod,returnandexchangemethodandothermajorinformation,takesecuritymeasurestoensurethatthetransactionissafeandreliable,andprovidegoodsorservicesaspromised.
Wherenetworkcommodityoperatorsandnetworkserviceoperatorsprovideelectronicformatcontractterms,theyshallcomplywithlaws,regulations,andrules,determinetherightsandobligationsofbothpartiestothetransactioninaccordancewiththeprincipleoffairness,andadoptreasonableandprominentThemethoddrawsconsumers’attentiontotermsthathaveamajorbearingonconsumerrightsandinterests,andexplainsthetermsinaccordancewiththerequirementsofconsumers.
Networkcommodityoperatorsandnetworkserviceoperatorsshallnotmakeunfairorunreasonableprovisionsforconsumersinelectronicformatcontractterms,orreduceorexempttheoperatorsfromtheirobligations,responsibilities,orexcludeorrestrictconsumptionThemainrightsoftheauthor.
Article14InternetcommodityoperatorsandInternetserviceoperatorsprovidingcommoditiesorservicesshallensuretheintegrityofthecommoditiesandservices,andshallnotunreasonablyseparatethecommoditiesandservicesForsale,theminimumconsumptionstandardshallnotbedeterminedandunreasonablefeesshallnotbechargedseparately.
Article15InternetcommodityoperatorsandInternetserviceoperatorsshallissuepurchasevouchersorservicereceiptstoconsumers,whichshallcomplywithrelevantnationalregulationsorbusinesspractices;collectconsumptionIftheapplicantagrees,itcanbeissuedinelectronicform.Electronicpurchasevouchersorservicereceiptscanbeusedasthebasisforhandlingconsumercomplaints.
Whereconsumersrequireonlinecommodityoperatorsandonlineserviceoperatorstoissuepurchasevouchersorservicereceipts,theoperatorsshallissuethem.
Article16InternetcommodityoperatorsandInternetserviceoperatorsshallhavetheobligationofsafecustody,reasonableuse,holdingwithinatimelimit,andproperdestructionofcollectedconsumerinformation;Informationthathasnothingtodowiththeprovisionofgoodsandservicesmustnotbecollected,mustbeusedproperly,andmustnotbedisclosed,rented,orsold.However,unlessotherwiseprovidedbylawsandregulations.
Article17Theinformationongoodsandservicestransactionspublishedbyonlinecommodityoperatorsandonlineserviceoperatorsshallbetrueandaccurate,andnofalsepropagandaandfalserepresentationsshallbeallowed.
Article18InternetcommodityoperatorsandInternetserviceoperatorsshallabidebythe"TrademarkLaw","UnfairCompetitionLaw","CompanyName"RegistrationManagementRegulations"andotherlaws,regulations,andrulesshallnotinfringeontherightsofotherstouseregisteredtrademarksandenterprisenames.
Article19InternetcommodityoperatorsandInternetserviceoperatorsshallnotuseInternettechnologyorcarrierstodamageotheroperators’businessreputation,productreputation,orinfringeUnfaircompetitionbehaviorssuchastherightholder’stradesecrets.
ChapterIIIObligationsofOperatorsProvidingOnlineTradingPlatformServices
Article20ProvidingOnlineTradingPlatformServicesThebusinessoperatorshallexaminetheidentityofthebusinessentityofthelegalperson,othereconomicorganization,ornaturalpersonthatappliestoprovidegoodsorservicesthroughtheonlinetradingplatform.
Operatorsprovidingonlinetradingplatformservicesshouldreviewandregistertherealidentityinformationofnaturalpersonswhodonotmeettherequirementsforindustrialandcommercialregistrationandapplytoprovidegoodsorservicesthroughtheonlinetradingplatform,establishregistrationfilesandregularlyVerifytheupdate.Amarkcertifyingthatthepersonalidentityinformationistrueandlegalisissued,anditisloadedonthewebpagewhereitengagesincommoditytransactionsorserviceactivities.
Whenreviewingandregistering,operatorswhoprovideonlinetradingplatformservicesshouldlettheotherpartyknowandagreetotheregistrationagreement,anddrawtheotherparty’sattentiontothetermsofobligationsandresponsibilities.
Article21Theoperatorprovidingonlinetradingplatformservicesshallsignacontract(agreement)withtheoperatorapplyingtoentertheonlinetradingplatformtoconducttransactions,clarifyingthatbothpartiesaretradingonlineRights,obligationsandresponsibilitiesintermsofplatformentryandexit,productandservicequalitysafetyassurance,andconsumerrightsprotection.
Article22Operatorsprovidingonlinetradingplatformservicesshallestablishonlinetradingplatformmanagementrulesandregulations,including:tradingrules,transactionsecurity,consumerrightsprotection,Regulationsandsystemssuchasthehandlingofbadinformation.Variousrulesandregulationsshouldbedisplayedontheirwebsite,andtechnicallyensurethatuserscanconvenientlyandcompletelyreadandsavethem.
Theoperatorprovidingonlinetradingplatformservicesshalltakenecessarytechnicalmeansandmanagementmeasurestoensurethenormaloperationoftheonlinetradingplatform,providenecessaryandreliabletradingenvironmentandtradingservices,andmaintaintheorderofonlinetrading.
Article23Operatorsthatprovideonlinetradingplatformservicesshallestablishinformationontheoperatorsthatprovidegoodsorservicesthroughtheonlinetradingplatformandtheinformationonthegoodsandservicestheypublish.Inspectingthemonitoringsystemanddiscoveringviolationsoflaws,regulations,andrulesofindustrialandcommercialadministration,theyshallreporttothelocaladministrativedepartmentforindustryandcommerce,andtaketimelymeasurestostopthem,andstopprovidingonlinetradingplatformservicestothemwhennecessary.
Iftheadministrativedepartmentforindustryandcommercediscoversthatthereisaviolationofthelaws,regulations,andrulesoftheindustryandcommerceadministrationintheonlinetradingplatform,andrequirestheoperatorsthatprovideonlinetradingplatformservicestotakemeasurestostopthem,andprovideonlinetradingplatformservicesOperatorsshouldcooperate.
Article24Operatorsthatprovideonlinetradingplatformservicesshalltakenecessarymeasurestoprotecttherighttoexclusiveuseofregisteredtrademarks,enterprisenamerightsandotherrights,andhaveevidencetoprovetotherightholderthatthenetworkOperatorsonthetradingplatformthatinfringeontheirregisteredtrademarkexclusiverights,enterprisenamerights,orotherunfaircompetitionactsthatdamagetheirlegitimaterightsandinterests,shalltakenecessarymeasuresinaccordancewiththeTortLiabilityLaw.
Article25Operatorsthatprovideonlinetradingplatformservicesshalltakenecessarymeasurestoprotectthesecurityofdataandinformationinvolvingthebusinesssecretsoftheoperatorsorthepersonalinformationofconsumers.Withouttheconsentofthepartiestothetransaction,datainvolvingbusinesssecretsorconsumerpersonalinformation,suchasthelistofpartiestothetransaction,ortransactionrecords,maynotbedisclosed,transferred,leased,orsoldtoanythirdparty.However,unlessotherwiseprovidedbylawsandregulations.
Article26Operatorsprovidingonlinetradingplatformservicesshallestablishaconsumerdisputesettlementandconsumerrightsself-disciplinesystem.Whereconsumerspurchasegoodsorreceiveservicesontheonlinetradingplatform,aconsumptiondisputeoccursortheirlegalrightsareharmed,theoperatorprovidingonlinetradingplatformservicesshallprovideconsumerswiththetruewebsiteregistrationinformationoftheoperator,andactivelyassistconsumersinmaintainingOwnlegitimaterightsandinterests.
Article27Encouragebusinessoperatorsthatprovideonlinetradingplatformservicestoprovidefairandimpartialcreditevaluationservicesfortransactionparties,andtoobjectivelyandimpartiallyassessthecreditstatusofbusinessoperators.Collectandrecord,establishacreditevaluationsystemandacreditdisclosuresystemtowarnoftransactionrisks.
Article28OperatorsthatprovideonlinetradingplatformservicesshallactivelyassisttheadministrativedepartmentforindustryandcommerceininvestigatingandpunishingillegaloperationsontheInternet,andprovideforillegaloperationsontheironlinetradingplatforms.Thebusinessoperators’registrationinformation,transactiondatabackupandothermaterialsshallnotconcealthetruesituation,andshallnotrefuseorobstructtheadministrativelawenforcementinspection.
Article29Operatorsprovidingonlinetradingplatformservicesshallreview,record,andkeepthecontentandreleaseofonlinecommoditytransactionsandrelatedserviceinformationpublishedontheirplatformstime.Theretentiontimeofthebusinesslicenseorpersonalrealidentityinformationrecordoftheoperatorshallnotbelessthantwoyearsfromthedateofregistrationandcancellationoftheoperatorontheonlinetradingplatform,andthebackupretentiontimeoftransactionrecordsandotherinformationrecordsshallnotbelessthantwoyearsfromthedateofcompletionofthetransaction.year.
Theoperatorprovidingonlinetradingplatformservicesshalladopttechnicalmeanssuchasdatabackupandfailurerecoverytoensuretheintegrityandsecurityofonlinetradingdataandmaterials,andshallensuretheauthenticityoftheoriginaldata.
Article30OperatorsprovidingonlinetradingplatformservicesshallregularlyreportonlinecommoditytransactionsandrelatedrelatedStatisticsofserviceoperations.
Article31Networkserviceoperatorsthatprovideservicessuchasnetworkaccess,serverhosting,andvirtualspacerentalfornetworkcommoditytransactionsandrelatedserviceactivitiesshallrequireapplicantsProvidebusinessqualificationsandpersonalrealidentityinformation,signnetworkservicecontracts,andrecordtheironlineinformationinaccordancewiththelaw.Theapplicant'sbusinesslicenseorpersonalrealidentityinformationandotherinformationrecordsbackupstoragetimeshallnotbelessthan60days.
ChapterIVSupervisionandAdministrationofOnlineCommodityTransactionsandRelatedServices
Article32OnlineCommodityTransactionsandRelatedServicesThesupervisionandmanagementofserviceactivitiesshallbetheresponsibilityoftheadministrativedepartmentforindustryandcommerceatorabovethecountylevel(includingthecountylevel).
Article33Theadministrativedepartmentforindustryandcommerceatorabovethecountylevelshallestablishacreditfile.
Article34Violatingthelawsandregulationsofindustrialandcommercialadministrationinonlinecommoditytradingandrelatedservices,thecircumstancesareserious,andmeasuresneedtobetakentopreventillegalwebsitesfromcontinuingtoengageinillegalactivities,Theadministrativedepartmentforindustryandcommerceshall,inaccordancewithrelevantregulations,requestthecommunicationsmanagementdepartmentwherethewebsiteispermittedtobeorderedtotemporarilyblockorstoptheillegalwebsiteaccessserviceinaccordancewiththelaw.
Article35Aftertheadministrativedepartmentforindustryandcommerceimposesadministrativepenaltiesontheillegalactivitiesofthewebsite,andneedstoclosetheillegalwebsite,itshallapplyforthecommunicationmanagementofthewebsiteinaccordancewithrelevantregulations.Thedepartmentshutdowntheillegalwebsiteinaccordancewiththelaw.
Article36Illegalactivitiesinonlinecommoditytradingandrelatedservicesshallbeunderthejurisdictionoftheadministrativedepartmentforindustryandcommerceatorabovethecountylevelwheretheoperatoroftheillegalwebsiteislocated.Iftheadministrativedepartmentforindustryandcommerceatorabovethecountylevelwheretheoperatorofthewebsitehasdifficultyinadministeringillegaloffendersinotherplaces,theillegalsituationoftheoffendermaybetransferredtotheadministrativedepartmentforindustryandcommerceatorabovethecountylevelwheretheoffenderislocated.
Article37Theadministrativedepartmentforindustryandcommerceatorabovethecountylevelshallestablisharesponsibilitysystemandasystemofaccountabilityforonlinecommoditytransactionsandrelatedservicebehaviors,andperformtheirdutiesinaccordancewiththelaw.
Chapter5LegalLiability
Article38ViolationoftheprovisionsoftheseMeasures,lawsandregulationshavepenalties,Punishmentinaccordancewithlawsandregulations.
Article39ViolationofArticle10Paragraph1,Article28,Article29,Article30oftheseMeasuresshallbewarned,Orderedtomakecorrectionswithinaspecifiedtimelimit,andthosewhofailtomakecorrectionswithinthetimelimitshallbefinedlessthan10,000yuan.
Article40ViolationoftheprovisionsofArticle20oftheseMeasuresshallbeorderedtomakecorrectionswithinatimelimit.Ifthecorrectionisnotmadewithinthetimelimit,afineof10,000to30,000yuanshallbeimposed.
Article41AnyonewhoviolatesArticle16andArticle25oftheMeasuresandinfringesonconsumer’spersonalinformationshallbewarnedandorderedtomakecorrectionswithinatimelimit.,Imposeafineoflessthan10,000yuan.
ViolationofArticle25oftheMeasuresandinfringementofbusinesssecretsofbusinessoperatorsshallbedealtwithinaccordancewiththe"Anti-UnfairCompetitionLaw"and"ProvisionsonProhibitionofInfringementofCommercialSecrets."

Article42TheStateAdministrationforIndustryandCommerceisresponsiblefortheinterpretationoftheseMeasures.
Article43TheprovincialadministrativedepartmentforindustryandcommercemayformulateguidelinesfortheimplementationofonlinecommoditytransactionsandrelatedserviceactivitiesinaccordancewiththeprovisionsoftheseMeasures.
Article44TheseMeasuresshallcomeintoforceonJuly1,2010.
